This website https://www.glittersports.com.au (the “Site”) is owned and operated by Glitter Sports Pty Ltd (ABN 99670318199) (“us”, “we” or “our”).
Your access to and use of the Site, including your order of products through the Site, is subject to these terms and conditions. By accessing, interacting with, browsing or using the Site, you agree to bound by, and comply with, these terms and conditions. If you are under 18 years of age, then you must obtain your parent or guardian’s consent before accessing and using the Site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of these products, violate any laws in your jurisdiction (including but not limited to copyright laws).
You agree not to copy, reproduce, duplicate, sell, resell or exploit any portion of our products.

Information and Data
You will be asked to provide information such as your name, address, phone number, email address and billing details. You agree to provide us with current, complete and accurate information. Credit card information is always encrypted during transfer over networks. We may ask you to provide additional details or require you to confirm your details (including your name, shipping address and billing address) to enable us to process any orders placed through the Site. 
Any order placed through this Site for a product is an offer by you to purchase the particular product for the price notified (including the delivery and other charges and taxes) at the time you place the order.

Products and Pricing 
The prices of our products are subject to change at our discretion and without notice. We reserve the right at any time to modify or discontinue products without notice at any time. All prices are in Australian Dollars (AUD)
We shall not be liable to you or to any third-party for any pricing changes, modifications, suspension or discontinuance of products.
Every effort has been made to accurately display the colors and images of our products that appear on the Site. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products offered. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
We do not warrant that the quality of any products, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

Orders and Cancellation
We reserve the right to accept or reject whole or part your order for any reason. We may, at our discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
Prior to the dispatch of an order, we may cancel all or any part of that order without any liability to you, if the requested products are not available or
there is an error in the price or the description posted on the Site in relation to a product; or the order has been placed in breach of these terms and conditions.
You cannot cancel all or any part of an order once it has been dispatched by us.
If we need to amend or reject/cancel an order we will endeavour to notify you of that rejection in a timely manner. we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We will not charge you for the cancelled order.

Delivery
We currently deliver orders to Australian addresses only. 
Delivery times may vary to some locations.
For bulk orders and remote locations please contact us for a delivery quote.
The delivery fee will be displayed at the time you provide the delivery address for the relevant order and may vary depending on the location of delivery and the delivery method that you select.
When you order a product via the Site, you agree to pay the following fees and charges if we accept your order: the purchase price of the product and 
the delivery fee for the product.

We will notify you if any additional delivery fees and freight charges are applicable once you finalise your order. You may incur additional delivery fees or freight charges (in excess of the fees and charges specified above) for:
(a) heavy, bulky or awkward items;
(b) express or urgent deliveries; or
(c) remote area deliveries

 

Your obligations 
You acknowledge and agree that:
1. All information and data provided by you through, or in connection with your use of, the Site is true, accurate, complete and current.
2. You will comply with all relevant laws and any reasonable instructions we give you relating to your use of the Site and your placement of any order to us.
3. You will check the labels on products before use and follow all instructions and guidelines associated with their use. 
4. You will not use the Site for any activities that breach any laws, infringe our intellectual property or a third party’s rights, or are contrary to any relevant standards or codes.
5. You will not make fraudulent or speculative enquiries, purchases or requests through the Site, use another person’s details without their permission, or impersonate another person when using the Site.
6. You will not do anything that alters or adversely affects the operation of the Site (including the ability of others to access and use the Site) including knowingly transmit any viruses, worms, defects, trojan horses or similar disabling or malicious code to the Site; use any AI, robot, spider, site search and retrieval application or other mechanism to retrieve or index any portion of the Site.

Liability 
While all reasonable care and skill is taken operating the Site, we cannot promise that the Site will always be available or free of faults or errors.
To the maximum extent permitted by law, except as expressly set out in these terms and conditions, we:
(a) make no representations or warranties, whether express or implied, in relation to the Site and any advice or information that is provided to you via the Site; and
(b) exclude any liability (whether in contract, tort (including negligence), or otherwise) for any indirect or consequential loss, damage or expense incurred by you or any other user or person in connection with Site or our products.
To the extent we are unable by law to exclude any implied condition, representation, warranty or statutory guarantee in relation to the provision of the Site or the products and the supply of the Site or a product is not of a kind ordinarily acquired for personal, domestic or household use or consumption, we limit our liability (at our option) to the re-supply of the Site or the products (as applicable), or payment for such re-supply.
To the extent permitted by law, our liability to you for loss or damage of any kind arising out of these terms and conditions is reduced to the extent that you caused or contributed to the loss or damage.

In no case shall Glitter Sports Pty Ltd our directors, officers, employees, affiliates, agents, contractors, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind or any damages arising from your use of the site or any products procured using the site, or for any other claim related in any way to your use of the Service or any product.

To the extent permitted by law, we will not be liable, nor be in default under these terms and conditions, for any failure to observe or perform any of our obligations under these terms and conditions for any reason or cause which could not, with reasonable diligence, be controlled or prevented by us. These causes include acts of God, nature (fire, flood, storm) acts or omissions of government or their agencies, strikes or other industrial action, riots, power shortages or failures, sudden and unexpected system failure or disruption by war or sabotage, and other acts or omissions of third parties.
